These terms cover your use of Qpushly, a Shopify application that sends web push notifications from your store. By installing the app you agree to them.
1. What the app does
Qpushly lets you collect web push subscribers from your storefront and send them broadcast campaigns and event-triggered automations. Delivery uses the Web Push standard, which means it depends on the shopper's browser and on the push service operated by their browser vendor.
2. Your responsibilities
- You are the controller of your shoppers' data. What you send, and to whom, is your decision.
- You will keep a privacy policy on your store that discloses your use of push notifications.
- You will not use the app to send unlawful, deceptive, harassing or misleading messages, and you will not impersonate anyone.
- You will not use the app to send notifications at a frequency intended to pressure or badger a shopper.
- You will comply with the marketing and consent laws that apply where your shoppers are.
3. Delivery is best-effort
We queue and sign your notifications and hand them to the shopper's push service. From that point delivery is outside our control: browsers throttle, revoke and expire subscriptions, devices go offline, and operating systems decide how and whether to display a notification. We do not guarantee that any particular notification is delivered, displayed, or seen.
4. Availability
We aim to keep the app available and will not deliberately take it down without notice, but we do not offer a service-level guarantee. Scheduled sends are processed on a recurring sweep, so a send may go out slightly after its scheduled time.
5. Fees and billing
Paid plans are billed by Shopify through its billing system and appear on your Shopify invoice. Prices and plan contents are those shown by Shopify at the time you subscribe. You can upgrade, downgrade or cancel from Shopify's own plan page at any time; cancellation takes effect at the end of the current billing period, and we do not issue partial refunds for an unused part of a period. Uninstalling the app stops future charges.
6. Free plan
The free plan is offered as-is and may change. We will give notice in the app before reducing what the free plan includes.
7. Your data
Your data remains yours. You can export your subscriber list at any time. Deletion is described in the Privacy Policy: tokens go on uninstall, everything else goes when Shopify sends the shop-redaction request that follows.
8. Suspension
We may suspend or terminate access if the app is used in breach of these terms, in a way that harms shoppers, or in a way that threatens the stability or security of the service. Where circumstances allow, we will tell you first.
9. Liability
To the maximum extent permitted by law, we are not liable for indirect or consequential loss, including lost sales or lost profits, arising from use of the app or from any notification being delivered, not delivered, or delivered late. Our total liability is limited to the fees you paid us for the app in the twelve months before the claim.
10. Changes to these terms
We may update these terms. Material changes will be announced in the app, and the date at the top of this page will change. Continuing to use the app after a change means you accept it.
